Welcome to BOOKESH.

These Terms & Conditions (“Terms”, “Terms and Conditions”, or “Agreement”) govern your access to and use of the BOOKESH website, platform, services, features, content, products, and related services.

By accessing, browsing, registering on, or using BOOKESH, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Return & Refund Policy, Shipping & Delivery Policy, Seller Policy, and any other policies applicable to a particular service or transaction.

If you do not agree with any part of these Terms, please do not use the BOOKESH platform or its services.

1. ABOUT BOOKESH

BOOKESH is an education-focused digital platform designed to connect students and educational communities with books, educational resources, bookstores, sellers, and assessment services.

BOOKESH may provide or facilitate services including, but not limited to:

  • 📝 Educational and study resources
  • 🎯 Online and digital tests
  • 🏫 Test and assessment services for coaching institutes

  • 🤝 Educational and institutional partnerships

The exact availability of any product, service, feature, or functionality may vary from time to time, by location, and according to operational requirements.

2. DEFINITIONS

For the purpose of these Terms:

“BOOKESH”, “we”, “us”, or “our” means the BOOKESH platform and its authorised operators, representatives, employees, contractors, or service providers, as applicable.

“User”, “you”, or “your” means any person who accesses or uses BOOKESH.

“Buyer” means a user who purchases or attempts to purchase a product or service through BOOKESH.

“Seller” means an individual, student, bookstore, business, institution, or other authorised party listing or offering a product through BOOKESH.

“Institute” means a coaching institute, educational organisation, school, college, training organisation, or other educational entity using BOOKESH assessment or related services.

“Platform” means the BOOKESH website, web applications, software, digital interfaces, communication channels, and related services.

“Content” includes text, images, photographs, descriptions, videos, documents, test questions, educational material, logos, graphics, reviews, data, and other information made available through the platform.

3. ELIGIBILITY TO USE BOOKESH

By using BOOKESH, you represent that:

  1. You are legally capable of entering into a binding agreement under applicable law; or
  2. Where you are not legally capable of entering into such an agreement, you are using the platform with the involvement and consent of your parent, legal guardian, or other legally authorised adult, wherever required by law.

Certain services may have additional age, eligibility, identity, or institutional requirements.

BOOKESH reserves the right to restrict, suspend, or terminate access where it reasonably believes that eligibility requirements have not been satisfied.

4. ACCEPTANCE OF TERMS

Your continued use of BOOKESH constitutes acceptance of these Terms.

BOOKESH may modify these Terms from time to time to reflect:

  • Changes in our services
  • New features
  • Operational requirements
  • Security requirements
  • Business or technical developments

5. BOOKESH AS A MARKETPLACE / PLATFORM

Where BOOKESH facilitates listings by independent sellers or bookstores, BOOKESH may act as a platform connecting buyers and sellers.

Unless expressly stated otherwise:

BOOKESH is not the owner of every product listed by third-party sellers.

Product descriptions, photographs, prices, availability, condition, edition, publication details, and other listing information may be provided by sellers.

Sellers are responsible for ensuring that the information they provide is accurate, lawful, and not misleading.

BOOKESH may take reasonable measures to review, moderate, remove, restrict, or investigate listings, but does not guarantee that every third-party listing will always be error-free or independently verified.

6. PRODUCT INFORMATION

We make reasonable efforts to display accurate information about products and services.

However, minor differences may occur due to:

  • Seller-provided information
  • Product condition
  • Printing or edition differences
  • Image quality
  • Typographical errors
  • Availability changes
  • Technical issues
  • Price updates
  • Third-party information

For used books, the actual condition may vary from one copy to another.

Users should carefully review the available description, photographs, edition, condition, price, seller information, and other relevant details before purchasing.

7. USED / PRE-OWNED BOOKS

Pre-owned books may show reasonable signs of previous use.

Depending on the listing, a used book may contain:

  • Writing or highlighting
  • Underlining
  • Marks
  • Folded pages
  • Cover wear
  • Age-related wear
  • Previous owner's name or markings
  • Other ordinary signs of use

The condition of a used book will depend on the individual listing.

Where condition information is provided, users should review it before placing an order.

BOOKESH does not represent that every pre-owned book will be in “like-new” condition unless the particular listing expressly states so.

8. SELLER RESPONSIBILITIES

Every seller using BOOKESH agrees that:

  1. They have the legal right to sell the listed product.
  2. The listing information is truthful and accurate.
  3. The product is not counterfeit or unlawfully reproduced.
  4. The seller will not intentionally misrepresent the condition of a product.
  5. The seller will comply with applicable laws.
  6. The seller will honour valid orders accepted through the platform, subject to applicable policies.
  7. The seller will not upload unlawful, misleading, fraudulent, infringing, harmful, or prohibited content.
  8. The seller will cooperate with BOOKESH regarding genuine customer complaints or disputes.
  9. The seller will provide accurate contact and identification information where required.
  10. The seller will comply with BOOKESH Seller Policies.

BOOKESH may suspend or remove seller accounts or listings where violations are identified or reasonably suspected.

9. PROHIBITED LISTINGS

Users must not list or offer products or content that:

  • Are counterfeit or unlawfully reproduced
  • Infringe copyright, trademark, patent, or other intellectual-property rights
  • Are stolen or unlawfully obtained
  • Contain malicious software
  • Are illegal under applicable law
  • Are fraudulent or deceptive
  • Contain prohibited or harmful material
  • Misrepresent their origin, ownership, condition, or authenticity
  • Violate the rights or privacy of another person
  • Violate BOOKESH policies

BOOKESH may remove or restrict any listing that violates applicable law or platform policy.

10. COPYRIGHT AND EDUCATIONAL MATERIAL

Users must not upload, sell, distribute, reproduce, scan, copy, or share copyrighted books, notes, question papers, PDFs, study materials, or other protected content unless they have the necessary rights, permission, licence, or other lawful basis to do so.

A person uploading content represents that they have the necessary rights or authorisation to provide that content.

If BOOKESH receives a valid intellectual-property complaint, it may investigate, restrict, disable, or remove the relevant content as appropriate.

BOOKESH respects the intellectual-property rights of authors, publishers, educators, institutions, and other rights holders.

11. TESTS & ASSESSMENT SERVICES

BOOKESH may provide testing and assessment services to students, coaching institutes, educational organisations, and other authorised entities.

These services may include:

  • Online tests
  • Offline/on-site tests
  • Mock examinations
  • Subject-wise tests
  • Topic-wise tests
  • Institute-level assessments
  • Test administration
  • Result generation
  • Rankings
  • Performance reports
  • Other assessment-related services

The exact scope of services will depend on the applicable agreement, package, order, or arrangement with the relevant institute or organisation.

12. INSTITUTE TESTING & ON-GROUND SERVICES

Where BOOKESH is engaged by an institute to conduct tests at an institute or designated location, the institute and BOOKESH may separately agree upon:

  • Test date
  • Test duration
  • Number of students
  • Syllabus
  • Test pattern
  • Number of questions
  • Test location
  • Staff requirements
  • Technical requirements
  • Result format
  • Reporting requirements
  • Fees and payment terms
  • Other operational requirements

BOOKESH may use employees, authorised representatives, contractors, technology providers, or other service partners to deliver such services.

13. TEST RESULTS AND PERFORMANCE DATA

Test scores, rankings, reports, analytics, and performance information are intended to provide educational and assessment-related insights.

Unless expressly guaranteed in writing, BOOKESH does not guarantee that a particular test score, ranking, performance report, or assessment result will result in:

  • Admission
  • Selection
  • Employment
  • Scholarship
  • Examination success
  • Competitive-exam qualification
  • Any particular academic outcome

Students and institutions remain responsible for interpreting and using assessment results appropriately.

14. TEST INTEGRITY

Users participating in tests must not:

  • Cheat
  • Use unauthorised assistance
  • Impersonate another student
  • Manipulate test results
  • Share restricted test content without permission
  • Attempt to bypass test controls
  • Interfere with the testing system
  • Use unauthorised software or devices where prohibited by the applicable test rules

BOOKESH or the concerned institute may take appropriate action in cases of suspected malpractice, including cancellation of a test attempt or result, restriction of access, or reporting to the relevant institution, subject to applicable law and the applicable test rules.

15. TEST QUESTION PAPERS AND CONTENT

Test questions, question banks, solutions, explanations, assessments, reports, and related material may be protected by intellectual-property rights.

Users must not reproduce, commercially distribute, publish, sell, upload, or share such material without appropriate authorisation.

Unauthorised reproduction may result in suspension of access and/or legal action where appropriate.

16. ORDERS AND PURCHASES

When a user places an order through BOOKESH, the order may be subject to availability and confirmation.

Placing an order does not necessarily mean that the order has been finally accepted.

BOOKESH or the relevant seller may cancel or reject an order where permitted by applicable law and policy, including circumstances involving:

  • Product unavailability
  • Pricing errors
  • Listing errors
  • Suspected fraud
  • Seller inability to fulfil the order
  • Technical errors
  • Payment problems
  • Operational limitations
  • Legal or regulatory requirements

Where applicable, eligible refunds will be processed according to the applicable Refund Policy.

17. PRICING

Prices displayed on BOOKESH may be provided by BOOKESH or third-party sellers, depending on the product.

Prices may change from time to time.

Where applicable, the final payable amount may include:

  • Product price
  • Delivery charges
  • Applicable taxes
  • Platform/service charges
  • Other disclosed charges

Any applicable charges will be communicated to the user before completion of the transaction, subject to technical limitations and applicable law.

18. PAYMENTS

Payments may be processed through authorised third-party payment service providers.

BOOKESH may not directly store complete payment-card information where payment processing is handled by such providers.

Users agree to provide accurate payment information and not to use fraudulent, unauthorised, or unlawful payment methods.

A transaction may be cancelled, rejected, or placed on hold where fraud, payment failure, suspicious activity, or other legitimate concerns are identified.

19. SHIPPING & DELIVERY

Where physical products are purchased, delivery may be handled by BOOKESH, sellers, logistics partners, or other authorised service providers.

Delivery timelines are estimates unless expressly guaranteed.

Delays may occur because of:

  • Weather
  • Transportation issues
  • Address problems
  • Seller delays
  • Logistics disruptions
  • Public holidays
  • Technical problems
  • Events beyond reasonable control

Users should provide accurate delivery information.

20. RETURNS, REFUNDS & CANCELLATIONS

Returns, refunds, replacements, and cancellations will be governed by the applicable Return & Refund Policy and the specific terms communicated for the relevant product or service.

Because used books may differ in condition and because some products/services may not be eligible for return, users should carefully review the applicable policy before purchase.

Nothing in this clause is intended to exclude or restrict any consumer right that cannot legally be excluded.

21. BOOKSTORE LISTINGS

BOOKESH may provide discovery or listing services for local bookstores.

Information about bookstores may include:

  • Business name
  • Location
  • Contact details
  • Categories
  • Services
  • Images
  • Business hours
  • Other business information

Where such information is provided by a third party, BOOKESH does not guarantee that every detail will remain accurate or current.

Bookstores are responsible for information they provide about their businesses.

22. USER ACCOUNTS

Users may be required to create an account to access certain features.

Users are responsible for:

  • Providing accurate information
  • Keeping account information updated
  • Maintaining password confidentiality
  • Preventing unauthorised access
  • Not sharing login credentials improperly
  • Not using another person's account without authorisation

Users should immediately notify BOOKESH if they reasonably suspect unauthorised access to their account.

23. USER-GENERATED CONTENT

Users may be permitted to submit:

  • Book photographs
  • Product descriptions
  • Reviews
  • Ratings
  • Comments
  • Questions
  • Suggestions
  • Other content

Users remain responsible for content they submit.

By submitting content, you confirm that:

  • You have the necessary rights to submit it;
  • It does not unlawfully infringe another person's rights;
  • It is not fraudulent or misleading;
  • It does not violate applicable law;
  • It does not contain prohibited material.

24. LICENSE TO USER CONTENT

By submitting content to BOOKESH, you grant BOOKESH a non-exclusive, worldwide, royalty-free licence, to the extent legally permissible and necessary for operating the platform, to host, store, reproduce, format, display, communicate, and otherwise use that content for platform-related purposes.

This licence does not transfer ownership of your underlying intellectual-property rights to BOOKESH.

You remain responsible for ensuring that you have the necessary rights to provide the content.

25. REVIEWS AND RATINGS

Users must provide honest and genuine reviews.

Reviews must not:

  • Contain false accusations
  • Be deliberately misleading
  • Contain personal information of others
  • Include abusive or unlawful content
  • Be manipulated through fake accounts
  • Be posted in exchange for undisclosed incentives

BOOKESH may moderate, restrict, or remove reviews that violate applicable law or platform policies.

26. ACCEPTABLE USE

You agree not to use BOOKESH to:

  • Commit fraud
  • Impersonate another person
  • Misrepresent information
  • Harass other users
  • Upload unlawful content
  • Infringe intellectual-property rights
  • Distribute malware
  • Attempt unauthorised access
  • Interfere with platform operations
  • Scrape or systematically copy platform data without permission
  • Reverse engineer protected platform components except where permitted by law
  • Circumvent security measures
  • Manipulate tests or rankings
  • Conduct transactions outside platform rules for fraudulent purposes
  • Use BOOKESH for unlawful activities

27. ARTIFICIAL INTELLIGENCE FEATURES

BOOKESH may use artificial intelligence or automated technologies for certain features, including book identification, information extraction, recommendations, analysis, or other platform functions.

AI-generated or automatically extracted information may occasionally contain errors.

Users should verify important information before relying on it.

AI-generated information should not automatically be treated as authoritative, guaranteed, or error-free.

BOOKESH may modify, improve, restrict, or discontinue AI features at any time, subject to applicable law.

28. THIRD-PARTY SERVICES

BOOKESH may integrate or rely on third-party services, including:

  • Payment providers
  • Logistics providers
  • Hosting providers
  • Analytics providers
  • Communication services
  • Technology providers
  • AI services
  • Maps/location services
  • Other service providers

Third-party services may be governed by their own terms and privacy policies.

BOOKESH is not responsible for independent failures, policies, or actions of third-party providers except to the extent liability cannot lawfully be excluded.

BOOKESH may contain links to third-party websites or services.

Such links are provided for convenience.

BOOKESH does not necessarily endorse or control third-party websites and is not responsible for their content, availability, security, or privacy practices.

Users should review the terms and policies of third-party websites before using them.

30. INTELLECTUAL PROPERTY OF BOOKESH

Unless otherwise stated, the BOOKESH name, logo, branding, website design, software, original graphics, text, platform structure, databases, and other original materials are owned by or licensed to BOOKESH and are protected by applicable intellectual-property laws.

Users may not copy, reproduce, modify, distribute, sell, publish, or commercially exploit BOOKESH intellectual property without prior written permission, except where permitted by law.

31. TRADEMARK

“BOOKESH” and associated logos, marks, designs, slogans, and branding elements may constitute trademarks or other protected intellectual property.

Unauthorised use is prohibited where such use infringes applicable rights.

32. PRIVACY

Your use of BOOKESH may involve the collection and processing of personal information.

Such processing is governed by the BOOKESH Privacy Policy and applicable data-protection laws.

Parents/guardians are encouraged to supervise minors' use of online services where appropriate.

BOOKESH may modify, suspend, or discontinue features or services subject to applicable law.

36. DISCLAIMER

To the maximum extent permitted by applicable law, BOOKESH provides its platform and services on an “as available” and “as is” basis.

BOOKESH does not guarantee that:

  • The platform will always be available;
  • Every listing will be error-free;
  • Every product will meet a user's expectations;
  • Every seller will fulfil every order;
  • AI-generated information will always be accurate;
  • Test results will predict future academic performance;
  • Any particular educational outcome will be achieved.

Nothing in these Terms excludes any guarantee, right, or remedy that cannot legally be excluded under applicable law.

37. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, BOOKESH shall not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of the platform, including loss of profits, data, opportunity, reputation, or anticipated benefits.

Where BOOKESH is legally liable for a particular transaction or service, its liability shall be limited to the extent permitted by applicable law and, where legally permissible, to the amount paid by the user for the relevant service or transaction giving rise to the claim.

This limitation does not apply to liability that cannot lawfully be limited or excluded.

38. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless BOOKESH, its authorised representatives, employees, service providers, and partners from claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your violation of these Terms;
  • Your unlawful use of the platform;
  • Your violation of another person's rights;
  • Your submitted content;
  • Your fraudulent or misleading activity;
  • Your breach of applicable law;
  • Your misuse of BOOKESH services.

This clause shall apply subject to applicable law.

39. SUSPENSION AND TERMINATION

BOOKESH may suspend or terminate an account or access to services where reasonably necessary, including where a user:

  • Engages in fraud;
  • Violates intellectual-property rights;
  • Misuses the platform;
  • Attempts to compromise platform security;
  • Engages in prohibited activity;
  • Creates risk to other users or BOOKESH.

Where appropriate, BOOKESH may provide notice or an opportunity to resolve the issue, subject to the circumstances and applicable law.

Termination does not automatically extinguish obligations that by their nature should survive termination.

40. FORCE MAJEURE

BOOKESH shall not be responsible for delay or failure caused by circumstances beyond its reasonable control, including:

  • Fire
  • Epidemics/pandemics
  • War
  • Civil unrest
  • Government actions
  • Internet or telecommunications failures
  • Cybersecurity incidents

41. GOVERNING LAW

These Terms shall be governed by the laws of India, subject to applicable mandatory consumer-protection and other statutory rights.

Nothing in these Terms is intended to deprive a consumer of rights or remedies that cannot legally be waived.

42. DISPUTE RESOLUTION

BOOKESH encourages users to first contact our support/grievance team to resolve complaints or disputes amicably.

Where a dispute cannot be resolved through internal communication, the parties may pursue remedies available under applicable Indian law.

Nothing in these Terms prevents a consumer from approaching a competent statutory authority, consumer commission, court, or other forum where such right is available under applicable law.

47. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a competent authority, that provision shall be modified or severed to the extent necessary, and the remaining provisions shall continue to remain effective to the extent permitted by law.

48. NO WAIVER

Failure by BOOKESH to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision later.

49. ASSIGNMENT

Users may not transfer or assign their rights or obligations under these Terms without appropriate authorisation.

BOOKESH may assign or transfer its rights and obligations as part of a business restructuring, merger, acquisition, transfer of assets, or other lawful business transaction, subject to applicable law.

50. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and other policies expressly incorporated into them, constitute the applicable agreement governing your use of BOOKESH, subject to any separate written agreement between BOOKESH and an institute, seller, business partner, or other organisation.

51. CHANGES TO BOOKESH SERVICES

BOOKESH is continuously developing.

We may introduce:

  • New features
  • New assessment formats
  • New marketplace categories
  • New seller tools
  • AI-based tools
  • New payment or delivery methods
  • New educational services
  • New institutional services

Availability may vary depending on location, technical capability, commercial arrangements, and other factors.

53. IMPORTANT LEGAL NOTICE

These Terms are intended to establish the general rules governing the use of BOOKESH.

Nothing in these Terms is intended to:

  • Exclude mandatory rights available under Indian law;
  • Remove statutory consumer protections;
  • Permit unlawful conduct;
  • Limit liability that cannot legally be limited;
  • Override a valid written agreement between BOOKESH and an institutional/business customer.

Where a specific service has separate terms, those terms may apply in addition to these Terms.

54. USER ACKNOWLEDGEMENT

By clicking “I Agree”, creating an account, placing an order, listing a product, registering for a test, participating in an assessment, or otherwise using BOOKESH, you acknowledge that:
