SELLER POLICY & SELLER AGREEMENT

Welcome to the BOOKESH Seller Platform.

BOOKESH enables students, individuals, bookstores, and other eligible sellers to list and sell permitted books and educational products through the BOOKESH platform.

This Seller Policy explains the rights, responsibilities, requirements, and standards applicable to sellers using BOOKESH.

By registering as a seller, creating a listing, accepting an order, or otherwise using BOOKESH's seller services, you agree to comply with this Policy, our Terms & Conditions, Privacy Policy, and other applicable BOOKESH policies.

1. 📚 WHO CAN SELL ON BOOKESH?

Depending on the applicable BOOKESH program, sellers may include:

👨‍🎓 Students

👤 Individual book owners

🏪 Local bookstores

📚 Educational book suppliers

🏫 Eligible institutions

🏢 Other approved sellers

BOOKESH may require sellers to provide appropriate information before allowing them to sell.

2. 📝 SELLER REGISTRATION

A seller may be required to provide information such as:

  • Full name
  • Mobile number
  • Email address
  • Address
  • City/state
  • Bank/payment information where applicable
  • Business details for bookstores
  • Identity or verification information where reasonably required
  • Other information necessary for seller onboarding

Sellers must provide accurate and current information.

Providing false, misleading, or fraudulent information may result in listing removal or account restriction.

3. 🔐 SELLER ACCOUNT RESPONSIBILITY

Sellers are responsible for:

  • Maintaining the confidentiality of their account;
  • Protecting their login credentials;
  • Keeping account information accurate;
  • Reviewing orders;
  • Responding to BOOKESH communications;
  • Following applicable BOOKESH policies.

A seller must not knowingly allow another person to misuse their account.

4. 📖 BOOK LISTING REQUIREMENTS

Every seller must provide accurate information about the book being listed.

Where applicable, listings should include:

  • Book title
  • Author
  • Publisher
  • Edition
  • ISBN
  • Language
  • Subject/category
  • Condition
  • Approximate age
  • Price
  • Available quantity
  • Relevant photographs
  • Other material information

The seller must not intentionally hide a material defect or provide misleading information.

5. ♻️ USED BOOK CONDITION

For pre-owned books, sellers should accurately describe the condition.

Relevant information may include:

  • Like New
  • Very Good
  • Good
  • Acceptable
  • Heavily Used

Sellers should disclose significant issues such as:

  • Missing pages
  • Damaged cover
  • Water damage
  • Excessive writing
  • Heavy highlighting
  • Torn pages
  • Missing supplements
  • Other material defects

Minor signs of normal use may be acceptable for pre-owned books but should not be deliberately misrepresented.

6. 📸 PHOTOGRAPHS

Where photographs are required, sellers should upload clear and reasonably accurate images of the actual book whenever possible.

Photographs should not be intentionally edited in a way that hides material defects.

Stock images may only be used where BOOKESH permits them and where they do not mislead the buyer regarding the actual product.

7. 💰 PRICING

Sellers are responsible for providing accurate prices.

A seller must not intentionally manipulate prices or provide misleading pricing information.

BOOKESH may display applicable:

  • Product price
  • Delivery charges
  • Platform fees
  • Discounts
  • Taxes where applicable
  • Other applicable charges

The final amount payable by the buyer will be shown during the applicable purchase process.

8. 📦 ORDER ACCEPTANCE

When a seller receives an order, the seller should fulfil the order according to the applicable BOOKESH process.

The seller must:

  • Confirm availability;
  • Provide the correct product;
  • Pack the product appropriately;
  • Dispatch within the applicable timeframe;
  • Provide required information;
  • Cooperate with delivery requirements.

Repeated failure to fulfil orders may affect seller eligibility.

9. 🚚 PACKAGING & DELIVERY

Sellers must package books appropriately so that they are reasonably protected during transportation.

Sellers should:

  • Use suitable packaging;
  • Protect books from unnecessary damage;
  • Ensure the correct book is packed;
  • Avoid including unrelated materials;
  • Follow BOOKESH shipping instructions.

Where BOOKESH manages logistics, sellers must hand over the order according to the instructions provided.

10. ❌ WRONG OR MISREPRESENTED BOOK

A seller must not intentionally send:

  • A different book;
  • A different edition where the edition was material to the listing;
  • An incomplete book;
  • A materially damaged book not disclosed in the listing;
  • A counterfeit book;
  • A book materially different from the listing.

Such conduct may result in listing removal, account restrictions, financial adjustments, or termination of seller privileges, subject to applicable law.

11. 🚫 PROHIBITED PRODUCTS

Sellers must not list products that are:

  • Illegal;
  • Counterfeit;
  • Pirated;
  • Stolen;
  • Fraudulently obtained;
  • Sexually explicit where prohibited by law or platform rules;
  • Infringing another person's intellectual-property rights;
  • Dangerous or prohibited;
  • Misleadingly represented;
  • Unauthorised copies of copyrighted material;
  • Otherwise prohibited by applicable law or BOOKESH policy.

BOOKESH may remove listings that violate these requirements.

12. ©️ COPYRIGHT & INTELLECTUAL PROPERTY

Sellers must have the legal right to sell the physical books or products they list.

A seller must not upload or sell:

  • Unauthorised photocopies;
  • Pirated books;
  • Unauthorised reproductions;
  • Copyright-infringing PDFs;
  • Unauthorised digital copies;
  • Counterfeit editions;
  • Material that infringes another person's intellectual-property rights.

Selling a genuine second-hand physical book is different from distributing unauthorised digital copies.

Sellers are responsible for ensuring that their listings comply with applicable intellectual-property laws.

13. 📄 STUDY MATERIALS & NOTES

Where BOOKESH permits educational notes or study materials to be listed, the seller must have the necessary rights or permission to sell/distribute the material.

Sellers must not upload:

  • Pirated textbooks;
  • Scanned copyrighted books without permission;
  • Paid course material without authorisation;
  • Unauthorised coaching material;
  • Copyrighted PDFs without permission;
  • Other infringing material.

BOOKESH may remove such content upon receiving a valid complaint or where infringement is identified.

14. 🤖 AI BOOK SCANNER

BOOKESH may provide an AI-assisted book scanning/listing feature.

The AI system may assist sellers by identifying or extracting information such as:

  • Book title
  • Author
  • ISBN
  • Publisher
  • Edition
  • Other book information

AI-generated information may contain errors.

The seller remains responsible for verifying the accuracy of the final listing before publishing it.

BOOKESH does not guarantee that AI-generated book information will always be accurate or complete.

15. 📦 INVENTORY RESPONSIBILITY

Sellers are responsible for keeping their inventory information reasonably accurate.

If a book has already been sold or becomes unavailable, the seller should update or remove the listing promptly.

Repeatedly accepting orders for unavailable products may result in account restrictions.

16. 🧾 SELLER RECORDS

Sellers should maintain appropriate records relating to their BOOKESH transactions where required by applicable law.

BOOKESH may maintain platform transaction records for operational, accounting, dispute-resolution, security, and legal purposes.

17. 💳 SELLER PAYMENTS

Where BOOKESH facilitates seller payments, the applicable payment terms may specify:

  • Seller payout amount
  • Platform fees
  • Commission, if applicable
  • Delivery adjustments
  • Refund/adjustment amounts
  • Applicable taxes
  • Payout schedule
  • Other applicable deductions

The seller should review the applicable commercial terms before accepting orders.

18. 💰 PLATFORM FEES & COMMISSION

BOOKESH may charge sellers fees or commissions for certain services.

Any applicable fee should be communicated through:

  • Seller onboarding information;
  • Seller dashboard;
  • Commercial agreement;
  • Order information;
  • Other applicable communication.

BOOKESH may change its fee structure prospectively by providing appropriate notice where required.

19. 💸 ADJUSTMENTS TO SELLER PAYOUTS

Where permitted and reasonably necessary, BOOKESH may adjust seller payouts for matters such as:

  • Cancelled orders;
  • Verified seller-related issues;
  • Incorrect product;
  • Material misrepresentation;
  • Fraud;
  • Delivery-related adjustments;
  • Applicable fees;
  • Other agreed contractual adjustments.

Any such action should be supported by relevant records and applicable terms.

20. 🔄 RETURNS & REFUNDS

BOOKESH generally operates physical-book orders under an Open Box Delivery / No-Return-No-Refund-after-acceptance model as described in the applicable Return, Refund & Cancellation Policy.

However, sellers must cooperate where a genuine issue is identified during delivery or where a remedy is required under applicable law.

Sellers must not misrepresent the condition of a book to avoid legitimate obligations.

21. 🛑 SELLER CANCELLATION

A seller should not cancel an accepted order without a genuine reason.

Repeated cancellations may:

  • Affect seller performance;
  • Reduce listing visibility;
  • Restrict selling privileges;
  • Result in account suspension;
  • Result in other appropriate action.

22. ⭐ SELLER PERFORMANCE

BOOKESH may monitor seller performance using legitimate operational indicators such as:

  • Order fulfilment;
  • Cancellation rate;
  • Listing accuracy;
  • Customer complaints;
  • Delivery issues;
  • Product condition;
  • Policy violations;
  • Fraud indicators.

These measures may be used to improve marketplace quality and protect buyers.

23. 🛡️ FRAUD & MISUSE

Sellers must not:

  • Create fake orders;
  • Manipulate ratings;
  • Use multiple accounts to manipulate the platform;
  • Provide false information;
  • Conduct fraudulent transactions;
  • Manipulate prices or listings;
  • Circumvent BOOKESH fees;
  • Attempt to move transactions outside BOOKESH for fraudulent purposes;
  • Abuse promotions;
  • Misuse buyer information.

BOOKESH may investigate suspicious activity.

24. 🔒 BUYER INFORMATION

Sellers may receive limited buyer information necessary to fulfil an order.

Sellers must:

  • Use buyer information only for legitimate transaction purposes;
  • Protect buyer information;
  • Not sell buyer information;
  • Not use buyer information for unrelated marketing without appropriate permission;
  • Not disclose buyer information unnecessarily.

Sellers must comply with applicable privacy and data-protection requirements.

25. 📢 SELLER MARKETING

Sellers must not use BOOKESH customer information to send unsolicited promotional communications.

Sellers must not falsely represent themselves as BOOKESH employees, representatives, or official partners unless authorised.

26. 🏪 BOOKSTORE SELLERS

Bookstores using BOOKESH may be required to provide additional business information.

Bookstores are responsible for:

  • Accurate business information;
  • Accurate inventory;
  • Correct pricing;
  • Order fulfilment;
  • Customer communication where applicable;
  • Compliance with applicable laws.

BOOKESH may separately verify participating bookstores.

27. 👨‍🎓 STUDENT SELLERS

Students may be permitted to sell books that they legally own and are entitled to sell.

Student sellers should not list:

  • Books they do not own;
  • Stolen books;
  • Counterfeit books;
  • Pirated material;
  • Unauthorised digital copies;
  • Another person's property without permission.

Where a seller is a minor, applicable parental/guardian requirements may apply depending on the transaction and law.

28. ⚠️ SELLER LIABILITY

The seller remains responsible for:

  • Accuracy of their listing;
  • Legality of the product;
  • Authenticity of the product;
  • Ownership/right to sell;
  • Condition information;
  • Fulfilment of accepted orders;
  • Compliance with applicable laws.

BOOKESH does not automatically assume responsibility for every representation made by an independent seller.

29. 📩 COMPLAINTS AGAINST SELLERS

If a buyer reports a problem with a seller or listing, BOOKESH may investigate.

BOOKESH may request:

  • Product photographs;
  • Listing information;
  • Order records;
  • Seller explanation;
  • Delivery information;
  • Other relevant evidence.

The seller must cooperate reasonably with such investigations.

30. 🚨 COPYRIGHT / IP COMPLAINTS

If a rights holder believes that a listing infringes their intellectual-property rights, they may contact BOOKESH with appropriate supporting information.

BOOKESH may:

  • Review the complaint;
  • Temporarily restrict the listing;
  • Request information from the seller;
  • Remove the listing where appropriate;
  • Take further action consistent with applicable law.

Repeated infringement may result in seller account termination.

31. ACCOUNT SUSPENSION

BOOKESH may temporarily suspend or restrict a seller account where there is a reasonable basis to believe that the seller:

  • Violated this Policy;
  • Provided false information;
  • Engaged in fraud;
  • Repeatedly failed to fulfil orders;
  • Listed prohibited products;
  • Infringed intellectual-property rights;
  • Misused buyer information;
  • Attempted to circumvent platform systems;
  • Created a security risk.

Where appropriate and legally permissible, BOOKESH may provide the seller an opportunity to address the issue.

32. ACCOUNT TERMINATION

BOOKESH may terminate seller access where there is:

  • Serious or repeated policy violation;
  • Fraud;
  • Illegal activity;
  • Counterfeit activity;
  • Serious intellectual-property infringement;
  • Abuse of the marketplace;
  • Repeated non-compliance;
  • Other legitimate grounds.

Termination does not automatically remove obligations relating to completed transactions, payments, disputes, confidentiality, or legal compliance.

33. SELLER CONTENT LICENSE

By uploading photographs, descriptions, or other listing content to BOOKESH, the seller grants BOOKESH the permission reasonably necessary to:

  • Display the listing;
  • Promote the listing on BOOKESH;
  • Process the order;
  • Operate the marketplace;
  • Improve platform services.

The seller retains ownership of content to the extent they legally own it.

The seller represents that they have the necessary rights to provide the content.

34. ACCURACY OF INFORMATION

Sellers must not intentionally provide misleading information.

BOOKESH may correct, restrict, or remove listings containing:

  • Incorrect information;
  • Misleading descriptions;
  • Inaccurate prices;
  • False condition claims;
  • Duplicate listings;
  • Prohibited content.

35. SELLER TAX & LEGAL RESPONSIBILITIES

Sellers are responsible for understanding and complying with the laws applicable to their own activities, including where applicable:

  • Tax obligations;
  • Business registration;
  • Invoicing;
  • Consumer obligations;
  • Intellectual-property requirements;
  • Product restrictions;
  • Other legal requirements.

BOOKESH may provide transaction-related information where required by law.

36. NO GUARANTEE OF SALES

BOOKESH does not guarantee that a seller will:

  • Receive a minimum number of orders;
  • Earn a particular amount;
  • Achieve a particular sales volume;
  • Receive a particular search ranking.

Marketplace visibility may depend on various factors.

37. MARKETPLACE AVAILABILITY

BOOKESH may modify, suspend, or discontinue seller features where necessary for:

  • Maintenance;
  • Security;
  • Legal compliance;
  • Technical upgrades;
  • Business reasons;
  • Other legitimate purposes.

38. DISPUTES

Seller disputes may first be addressed through BOOKESH's internal support process.

Where a separate seller agreement exists, the dispute-resolution provisions of that agreement may apply.

Nothing in this Policy prevents a party from exercising rights available under applicable law.

39. CHANGES TO THIS SELLER POLICY

BOOKESH may update this Seller Policy from time to time.

Changes may be made due to:

  • New marketplace features;
  • Changes in law;
  • New seller requirements;
  • Operational changes;
  • Security improvements;
  • Business requirements.

The updated version will be published on this page.

40. SELLER ACKNOWLEDGEMENT

By registering, listing a product, accepting an order, or otherwise using BOOKESH as a seller, you acknowledge that:

You have read, understood, and agreed to comply with this Seller Policy and the other applicable BOOKESH policies.

You also acknowledge that you are responsible for the accuracy and legality of the products and information you provide.
